Welcome to Adventure Pest & Wildlife (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website located at https://adventurepest.com/ and the pest control services we provide. By scheduling service, creating an account, or using our website or customer portal, you agree to these Terms.
If you do not agree, you must discontinue use of our services.
- Services Provided
Adventure Pest & Wildlife provides residential pest control, termite control, wildlife management, weed control, bird control, and rodent control services. Services may be one-time or recurring and are subject to availability, inspection results, and environmental conditions.
We reserve the right to refuse or discontinue service at our discretion, including when conditions pose safety risks to our technicians.
- Customer Responsibilities
You agree to:
- Provide accurate property and contact information
- Ensure safe access to the property at scheduled times
- Secure pets and notify us of hazards
- Follow all preparation and post-treatment instructions
Failure to comply may result in additional charges or service cancellation.
- Recurring Service & Auto-Pay Authorization
Certain services are offered on a recurring subscription basis. By enrolling in recurring service, you authorize Adventure Pest & Wildlife to charge your payment method on file automatically according to your selected service plan.
Payments are processed through a third-party billing provider (Briostack). We do not store full payment card details.
Recurring services continue until canceled. You may cancel by contacting us at least 48 hours prior to your next scheduled billing or service date. No refunds are issued for services already performed.
Returned payments, declined transactions, or chargebacks may result in suspension or termination of service.
- Pricing & Payment Terms
Service pricing is subject to change with notice. Late payments may incur fees. We reserve the right to collect unpaid balances, including use of collections services where permitted by law.
All sales are final unless otherwise required by Arizona law.
- Customer Portal Use
Customers may access a secure portal to manage appointments, billing, and service records. You agree to:
- Maintain confidentiality of login credentials
- Not share or misuse account access
- Notify us immediately of unauthorized access
We are not liable for losses resulting from compromised credentials caused by user negligence.
- Service Limitations & Disclaimer
Pest control involves environmental and biological variables beyond our control. While we strive for effective results, we do not guarantee permanent elimination of pests.
Services reduce pest populations but cannot ensure complete eradication or prevention of future infestations.
Weather, structural conditions, neighboring properties, and sanitation factors may affect results.
- Limitation of Liability
To the fullest extent permitted by Arizona law:
Adventure Pest & Wildlife is not liable for incidental, indirect, special, or consequential damages, including property damage, lost income, emotional distress, or personal injury arising from service performance or website use.
Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
- Indemnification
You agree to indemnify and hold harmless Adventure Pest & Wildlife and its employees from claims arising from:
- Unsafe property conditions
- Failure to follow instructions
- Misrepresentation of property hazards
- Third-party actions on your property
- Arbitration Agreement
Any dispute arising from these Terms or services shall be resolved through binding arbitration in Arizona, not in court. You waive the right to a jury trial and class action participation.
Arbitration will be conducted under the rules of the American Arbitration Association. Each party bears its own legal costs unless otherwise awarded.
- Privacy & Data Collection
We collect personal information necessary to provide services, including contact details and service history. Payment processing is handled by third-party providers.
Use of our website and services is also governed by our Privacy Policy. By using our services, you consent to data collection consistent with that policy.
- Website Use
You may not:
- Use the site for unlawful purposes
- Attempt to hack or disrupt services
- Copy proprietary content
- Impersonate others
We reserve the right to terminate access for violations.
- Governing Law
These Terms are governed by the laws of the State of Arizona. Any legal proceedings permitted outside arbitration must occur in Arizona courts.
- Modifications to Terms
We may update these Terms at any time. Continued use of services after updates constitutes acceptance of the revised Terms.
